NATIONAL LAW REGULATION OF INDUSTRIAL FISHING IN UKRAINE

The article focuses on the research on the current state of water bio resources used, highlighting the conditions for successful and efficient functioning of fisheries as a branch of the national economic complex of Ukraine. The efficiency of control over the fish harvest as well as the way the industrial fishing is organized and regulated were analyzed in the article. Such programs as the National Program of Fisheries Development of Ukraine for the period up to 2010, the National Program of Environmental Protection and Reproduction of the Azov and the Black Seas until 2010, the State Referral Economic Program targeting on Fisheries Development during 2012– 2016 were mentioned. The types of use of water bio resources were signified, the procedure for setting limits on the special use of water bio resources of national importance within the jurisdiction of Ukraine was determined. The Rules of Industrial Fishing in the Black and the Azov Seas and the Fishing Regimes that complement them were also analyzed. The mechanism of special use of water bio resources that are under the conditions of Natural Will (except for the species listed in the Red Book of Ukraine) in inland fisheries was analyzed. The activity of the State Fishing Agency was analyzed in the part of distribution of limits for special use of water bio resources on shares of fishing for industrial purposes in fisheries (being their parts) between users of water bio resources as well as rights and obligations of users of water bio resources on volume of water resources consumption. The differences in the Orders given by the Ministry of Agrarian Policy and Food of Ukraine which regulate Fishing Regimes for the period from 2017 to 2021 were analyzed and determined. Some special features of the Black Sea fishing were signified under certain conditions of specialized fishing in the Black Sea. The frameworks of the Maritime Doctrine of Ukraine in concern with fisheries development were presented, the implementation of state policy in the field of fisheries and fishing industry was traced in some acts, for example the Act which regulates the special Fishing Regime in fisheries, 2021.
