The article presents the historical and legal analysis of the transformation of the corrective labor legislation of the USSR and Ukraine into the penal legislation of an independent state.Numerous attempts to improve, to reform and to reorganize of both legislation and the penal system of the state are analyzed. The article states that in the circumstanses of humanization of society activities in this area should be aimed at ensuring human rights and freedoms, and penal legislation should be brought into line with international norms and European standards.
