Application of Special Expertise in Criminal Proceedings on Deliberate Destruction of Another's Property

Abstract

The article tackles certain aspects of application of special expertise in criminal proceedings on deliberate destruction of another's property. In the focus of attention is the role and importance of forensic examination in investigating the aforementioned crimes. The author places importance on the reasons for appointment of criminal expertise and its procedure and draws conclusions that in criminal proceedings on deliberate destruction of another's property an investigator can appoint any kind of expertise, which may appear to be of great importance in each particular case depending upon a subject of investigation. It can be fire and technical expertise and certain types of forensic examination: chemical, electro-technical physico-technical, forensic-medical, commodity, forensic- veterinary, expertise of materials, substances and products. The author lays emphasis on the fact that expert’s conclusion as to the special expertise results cannot be used as evidence in criminal proceedings without preliminary analysis and evaluation of expert’s conclusion.
