Doctrine of Legitimacy and Sovereignty of the People in State-legal Views of the Sociological School of Law Representatives in Germany in the Second Half of Nineteenth - the First Quarter of the Twentieth Century

The article presents complex analysis of state-legal views of representatives of the sociological school of law in Germany in the second half of nineteenth - the first quarter of the twentieth century, who laid the foundations of the state-legal doctrine of democratic legitimacy which included teaching about the legitimacy of the government and sovereignty of the people. According to them the activity of state power should be limited to the legal framework, in particular, to the system of state guarantees in the observance and protection of human rights and freedoms or self-terminated with obligatory compliance with mandatory requirements of «bilateral legal norms» In a modern legal state only legal (rational) domination has legitimacy. The author concludes that the bases of this type of domination are clearly established rules formalized in the form of laws. The state power in order to be stable and effective should have the support among the people. In regard with this, the level of legitimacy of state power depends on the level of the legal awareness of people.
