Operative-Investigative Measures to Prevent Encroachment on the Personal Security of the Convicts in Penitentiary Institutions of Ukraine

Abstract

The article deals with the current state of scientific substantiation of the problems concerning the issues of security in the places of detention where the convicts serve their sentence. The analysis is focused on the legal acts and bills of law related to the personal security of the convicts and the need for modification of the existing penal laws in Ukraine. The author proposes a set of measures to be taken to improve the existing legal framework of draft laws and a variety of other legal sources aimed at the solution of the problem. It is concluded that the state at a legislative level ought to create the conditions of serving the sentence, which are aimed at the improvement of life safety measures in correctional colonies. The author singles out penitentiary measures and processes occurring in the course of serving a sentence of imprisonment, which fall into a category of a constraining factor for prisoners and for the rest of population. This article suggests the classification of tactical means in view of the absence of such both in the science of penal law and in the operational-investigative activities, and in the view of the existing practical challenges confronted by the operating units at the correctional facilities.
