Local Self-Governing Principles in Ukraine: Сoncept, Сontent and System

The article reveals the essence and content of the category «principles of local self-government», its utilization in the national constitutional law-making and law-enforcement practice. The category of principles of local self-government is considered in the context of the local self-government reforming in Ukraine (2015-2017) in terms of the decentralization principles. In the focus of attention are the sources that define the principles of the international law, their classification, characteristics and systematization. The author argues that it is possible to distinguish two types of principles of local self-government which are interrelated:1) international and regional (European) principles of local self-government; 2) nationwide principles of local self-government. In accordance with the Constitution of Ukraine it is possible to distinguish the following principles of local self-government: 1) the rule of law in the activities of local self-government;2) inalienability of the citizens right to local self-government; 3) democracy, election and variability of the local self-government representative bodies; 4) equal access of citizens to the service in local self- government bodies; 5) transparency in the organization of the local self-government bodies activities;6) subsidiarity; 7) decentralized system of public powers; 8) voluntary association of territorial communities. The key findings of the study give grounds to claim that taken all together the general principles of the local self-government in Ukraine, represented by international (supranational) and intrinsic (national) principles, form a holistic integrated system.
