Protection of the Intellectual Property Right in the Music Industry

Abstract

The article deals with the problems of intellectual property rights protection and its violation in various forms in the field of music industry. Examples of such phenomena are presented in the Polish and foreign music industry. The causes and consequences of violation of intellectual property rights are revealed. New rules and improvements in the functioning of the Polish judicial system for the restoration of copyright infringements should make such judicial protection more effective. In the twenty-first century, work in the music industry is extremely simple and at the same time equally complex and demanding. New technologies, tools and devices, styles, social changes and situations create a field for the creativity of authors, musicians and producers. The difficulty lies in the fact that it is practically impossible not to duplicate someone else's creativity, even without realizing it. Not being aware, the artist can unconsciously create a similar subject.Everything has already been invented and it is difficult to create something original and entirely new. Even original works may have elements of other works. Therefore, the protection of intellectual property, as well as copyright and related rights, must be constantly developed and enforced. It is very difficult to detect the actual use of plagiarism or other copyright infringement in different situations. Strengthening efforts and increasing funding for informing the public, implementing social campaigns to protect intellectual property rights of artists should raise awareness of the scale of the problem in people.
